The concern is that the language of allowing parents to opt out is not clearly stated and leaves a great deal of interpretation to the DOE and subsequently to districts. As, Senator Deutch, Palm Beach County, noted in his comments, schools could make PE the default choice for schedules and there would be a large number of parents who would not know they had an option. This is certainly our concern and we would like clean up the language before we provide support for this bill. So, it is important to keep the awareness of this issue in front of committee members.

In the Senate, the committee which will hear the bill next will be the Health Policy Committee and the Education Appropriations K-12 Committee. Please take a look at the members of those committees to see if one of them is YOUR senator. It is important to note this bill would not be moving without the strong pressure from the Governor – and he should be hearing from our supporters, as well as the committee members.

The bill has not moved in the House – and certainly, there is still time for it to do so, given any support in that chamber and pressure from the Governor .
